The Department of Justice is considering an antitrust lawsuit to stop a merger of AT&T (T) and Time Warner (TWX), it was reported Thursday.

The Wall Street Journal reported AT&T officials have met with the Justice Department in recent weeks. The Justice Department hasn’t made a final decision, and timing on any outcome is uncertain.

AT&T is in the process merging with Time Warner. AT&T says it expects the $85 billion purchase of Time Warner to close by year end.

The report said the Justice Department is in settlement talks that could lead to approval with conditions but is preparing for litigation in case it decides to go to court.

AT&T shares were up 0.2%, near 33.60 during morning trading on the stock market today. Time Warner shares were down 4.7%, near 93.65.
